We are: Equidae Botanical Horse Care (hereinafter referred as “Seller” / “we” / ”us” / ”our”), a company incorporated in Australia with its business office at 35 Aberfeldy Road, Closeburn, Queensland, 4520 Australia. Email: equidaesales@gmail.com
These terms and conditions of sale, as amended from time to time by Equidae Botanical Horse Care, apply to all sales of Products to the Customer.
Orders
Monday to Friday will be processed upon customer payment on the same day and will be dispatched next day. (excludes weekends, public holidays or during high holiday season)
Equidae Botanical Horse Care reserves the right to cancel, suspend or vary any incomplete order that has already been accepted by Equidae Botanical Horse Care, if the Customer defaults, under these terms and conditions. Such suspension, cancellation and variation shall be without any notice and liability to the Customer.
Equidae Botanical Horse Care is not responsible to the Customer for a breach of its obligation to supply Equidae Botanical Horse Care products, pursuant to an accepted order, or for any delay in delivery, if the failure to supply or the delay in delivery, is caused by matters beyond the reasonable control of Equidae Botanical Horse Care (including, without limitation, acts of God, acts of government, war or other hostility, national or international disaster, fire, explosion, power failure, equipment failure, strike or lockout, inability to obtain necessary supplies and any other force majeure occurrence).
Payments
We accept credit cards Visa, Master Card and via Pay Pal. All payments are processed through third party website and Pay Pal.
Risk in the Product
The risk of loss or damage to the Product passes to the Customer on the date and at the time that the Product is removed from storage for the purpose of delivery to the Customer. The Customer acknowledges that the Equidae Botanical Horse Care products ordered classified as ‘’all natural’’ and are produced in small batches and use minimum preservatives; and as such all products will be stored below 25 degrees or less at all times and products containing 100% essential oils shell be stored away from direct heat and sun. Equidae Botanical Horse Care shall not be liable to the customer for any deterioration of any products not correctly stored whatsoever and howsoever arising; including arising from the shipment of the goods from Equidae Botanical Horse Care to the customer.
Return Policy
The Equidae Botanical Horse Care warrants that any Product/Packaging sold by it will be free from defects and products will be manufactured freshly. This warranty does not apply where in the Equidae Botanical Horse Care’s opinion a defect has been caused by careless or improper handling. For the purpose of making any claim in accordance with this clause the Customer must: immediately upon becoming aware of circumstances or within 48 hours of receiving the product, giving rise to a claim under this clause and notify Equidae Botanical Horse Care in writing setting out full particulars of the claim;
If you receive a package that has been opened or damaged, you must save the original box, carton, jars or anything that has been damaged. Please inform Equidae Botanical Horse Care immediately of the damaged goods. Do not send merchandise back without informing Equidae Botanical Horse Care sales representative, as all returns without authorization will be refused.
Equidae Botanical Horse Care will accept returns of faulty goods as required by law. Equidae Botanical Horse Care will not otherwise accept return of goods unless the return is approved by Equidae Botanical Horse Care’s authorized representative and the goods are returned in their original condition.
Notices
Any notice required under this agreement must be in writing and given by post or hand to Equidae Botanical Horse Care or the Customer at the address set out in this agreement or at such other address or facsimile number as is notified in writing by one party to the other.
Governing law
This agreement is governed by the laws of the State specified in the schedule notwithstanding the place in which the Product or any of them are to be delivered. The Customer and the Seller irrevocably submit to the exclusive jurisdiction of the Courts of that State.
Whole agreement
These terms and conditions and any warranties implied by law which are not capable of being excluded or modified embody the whole agreement between the parties and, subject to the express terms contained in any written order and written acceptance thereof (which will only apply to that particular order), all previous negotiations, representations, warranties, arrangements and statements (if any), whether expressed or implied, including any collateral agreement or warranty, regarding the subject matter or the intentions of either of the parties are merged in these terms and conditions and otherwise are hereby excluded and cancelled. The Customer acknowledges that it has not been induced to enter into this agreement by any representation, advice or information given or made by or on behalf of Equidae Botanical Horse Care.
All disputes as to the legality, application, interpretation or performance of this order or any of its terms and conditions shall be governed by the laws of the State
